The good news is there may be a way to put an end to all the collection calls and letters, as well as the stress they generate. Perhaps the most important provision of our bankruptcy law is the "automatic stay" which comes into effect immediately upon the filing of a bankruptcy petition. Once notified of the filing of a bankruptcy petition, creditors must immediately stop all collection efforts, including harassing debt collection telephone calls and letters.

In addition, the filing of a bankruptcy petition will also halt all pending lawsuits and sheriff sales. A filing will also delay the foreclosure on a home, usually long enough to allow the debtor to make arrangements with the lender to keep the house, but if that's not possible, time to find alternative housing.
