Generally, marital assets are those which were acquired from the date of the marriage until the date of final separation. There are even circumstances where a portion of assets acquired by one spouse before marriage or after final separation can be available for division between the parties.
It is best to obtain the advice of an experienced attorney who is knowledgeable in divorce law to determine when final separation has occurred and what property is available for distribution by agreement or at an equitable distribution hearing.
