Qualifying for Chapter 7 Bankruptcy and Discharging Debt

Chapter 7 bankruptcy is very advantageous because it allows debtors to discharge unsecured debt such as credit card bills, personal loans and medical debt. However, certain assets are exempt from Chapter 7, such as support orders from a divorce and student loans. In addition to unsecured debt elimination, Chapter 7 places an "automatic" stay on creditors in order to stop creditor harassment and home foreclosure proceedings.

Chapter 7 bankruptcy gives qualifying debtors the Opportunity to eliminate secured debts, such as mortgages and car loans, but in order to obtain a discharge of such debt, the house or car may have to be surrendered to the lender.

In order to obtain the benefits from a Chapter 7 bankruptcy filing, one must meet certain qualifications which mainly involve gross household income. Gross income is determined by multiplying the last six months of his or her wage earnings by two. Sometimes it is appropriate to delay filing to benefit from this factor, while under other circumstance it is better to hurry. I can help you make that decision.

In most cases, a person who has filed for a Chapter 7 bankruptcy within the preceding 8 years cannot file again until the waiting period has expired. Sometimes this restriction can be overcome if one spouse has not filed within the exclusion period.

Another issue that must be evaluated is the amount of equity (market value less mortgage and home equity debt) a debtor has in their home. I will help you determine if the amount of your equity will allow you to keep your home.
